1. Introduction
Welcome to IBeanThere. These Terms of Service ("Terms") constitute a legally binding agreement between you and IBeanThere ("we," "us," or "our"). By accessing or using our mobile application and services, you agree to be bound by these Terms. If you do not agree to these terms, pleaes do not use our services.
2. User Accounts & Security
To access certain features, you must create an account. You agree to provide accurate, current, and complete information. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. We reserve the right to disable any user account if we believe you have violated these Terms.
3. User Content & License
Our service allows you to post reviews, photos, and other content. You retain ownership of your content. However, by posting, you grant IBeanThere a perpetual, irrevocable, worldwide, non-exclusive, royalty-free license to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute any such content in any media or distribution methods now known or later developed.
4. Prohibited Conduct
You agree not to: (i) use the service for any illegal purpose; (ii) harass, abuse, or harm another person; (iii) reverse engineer, decompile, or attempt to extract the source code of the software; (iv) use any robot, spider, or automated device to access the service; (v) interfere with the proper working of the service.
5. Location Services
Some features of our app require access to your device's location. You can control these permissions through your device settings. We use location data to provide local cafe recommendations and verify visits. By using these features, you consent to such usage as described in our Privacy Policy.
6. Termination
We may suspend or terminate your access to the service at any time, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Service will immediately cease.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW (INCLUDING THE CONSUMER PROTECTION ACT OF ONTARIO), IBEANTHERE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US, IF ANY, IN THE PAST SIX MONTHS OR 50 CAD, WHICHEVER IS GREATER.
8. Dispute Resolution & Arbitration
ANY DISPUTE, CLAIM OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS OR THE BREACH, TERMINATION, ENFORCEMENT, INTERPRETATION OR VALIDITY THEREOF SHALL BE DETERMINED BY BINDING ARBITRATION ON AN INDIVIDUAL BASIS. YOU AND IBEANTHERE WAIVE THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN A CLASS ACTION.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to its conflict of law provisions.
10. Changes to Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
