Terms of Service
Translations are provided for convenience. To the extent permitted by applicable law, the English version governs if versions differ. This does not limit mandatory language or consumer rights.

1. Introduction
ibeanthere is a website and service operated by an individual (the "Operator", "we", "us", or "our"), not a separate incorporated entity. These Terms govern your use of the website and related services (the "Services"). By using the Services, you agree to these Terms to the extent an enforceable agreement is formed under applicable law. If you do not agree, please stop using the Services. You can contact the Operator at support@ibeanthere.app. Nothing in these Terms excludes, restricts, or waives any right, remedy, warranty, or liability that cannot lawfully be excluded, restricted, or waived, including under applicable consumer protection and privacy laws. This safeguard applies to every section.
2. User Accounts & Security
Provide accurate account information, keep your credentials secure, and notify us if you suspect unauthorized access. You are responsible for your own use of your account and for activities you authorize, subject to applicable law. You must be at least 13 to use the Services. If you are below the age of majority where you live, a parent or legal guardian must review these Terms and authorize your use to the extent required by law.
3. User Content & License
You retain ownership of the coffee logs, photos, ratings, and other content you submit. You must have the rights and permissions needed to submit it, including any necessary permission from identifiable people. Do not submit unlawful, defamatory, infringing, or misleading content or disclose private information without lawful authority. You grant the Operator a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, format, and display your content only as needed to operate and provide the Services, respecting the visibility settings you select. Service providers may process it on our behalf for those purposes. This licence does not authorize unrelated advertising use of private content. We may restrict or remove content reasonably believed to violate these Terms, another person's rights, or applicable law. Report concerns to support@ibeanthere.app. The licence ends when your content is removed from the active Services, except as needed for lawful limited retention described in the Privacy Policy. Shared place data may remain with your personal attribution removed. Public content may have been copied independently by others; we cannot promise removal of copies outside our control.
4. Prohibited Conduct
Do not use the Services for unlawful activity, harassment, impersonation, fraud, spam, infringement, or unauthorized disclosure of personal information. Do not submit fabricated reviews, manipulate ratings, access accounts or systems without authorization, bypass security or access controls, or disrupt the Services. Automated collection or access that bypasses restrictions, extracts personal information without authority, or places an unreasonable load on the Services is prohibited. These restrictions do not prohibit activities or rights that applicable law does not allow us to restrict.
5. Location Services
Location features use your device location with permission to show nearby cafes and support visit verification, as described in the Privacy Policy. You can manage location permission in your browser or device settings; some features may then be unavailable. Location, directions, and verification results can be inaccurate. Check conditions and cafe information independently and use your judgment when travelling.
6. Termination
We may modify, suspend, or discontinue all or part of the Services, or restrict an account or content, for reasonable operational, security, legal, or policy enforcement reasons. Where reasonably practicable, we will provide notice of a material interruption or restriction; urgent safety, security, or legal circumstances may require action without prior notice. Any mandatory notice, refund, or other legal obligation still applies. You may stop using the Services and request account deletion in Settings. The Privacy Policy explains deletion and limited retention. Provisions that by their nature need to continue, including accrued rights, lawful liability limits, and dispute resolution, survive termination only to the extent permitted by law.
7. Limitation of Liability
The Services provide coffee and cafe information, including user contributions and third-party content. We do not operate the listed cafes or guarantee their products, safety, opening hours, prices, availability, or the accuracy of reviews. Confirm important details, including allergens and accessibility, directly with the cafe. A listing or link does not by itself imply endorsement or a business relationship. To the extent permitted by applicable law, the Services are provided "as is" and "as available", without warranties of accuracy, fitness for a particular purpose, uninterrupted availability, or error-free operation. Keep your own copies of content you need. This paragraph does not exclude any mandatory warranty or our legal obligations. To the extent permitted by applicable law, the Operator is not liable for indirect, incidental, special, consequential, or punitive damages arising from the Services. Subject to the exclusions below, the Operator's aggregate liability arising from the Services or these Terms is limited to the greater of CAD 50 and the amount you paid the Operator for the Services during the six months preceding the event giving rise to the claim. Payments to a cafe or another third party are not payments to the Operator. These exclusions and the cap do not apply to fraud, wilful misconduct, gross negligence, or any liability, statutory remedy, or consumer or privacy right that applicable law does not permit us to exclude or limit. They apply only to the extent enforceable in your circumstances.
8. Dispute Resolution
You may contact support@ibeanthere.app to seek an informal resolution. Doing so is voluntary and is not a prerequisite to a court proceeding, urgent relief, a regulatory complaint, or exercising any legal right. Contacting us does not pause or extend a legal deadline unless the law or a valid agreement provides otherwise. These Terms do not require arbitration and do not waive a right to bring or participate in a class proceeding, access a competent court (including Small Claims Court where applicable), or obtain a jury trial where available by law. After a dispute arises, you and the Operator may voluntarily agree to mediation or arbitration.
9. Governing Law
These Terms are governed by the laws of Ontario and the federal laws of Canada applicable there, subject to any mandatory protections or conflict-of-laws rules that apply to you. Ontario courts with subject-matter jurisdiction may hear disputes. Nothing requires you to use an Ontario court where applicable law gives you the right to bring proceedings elsewhere or deprives you of mandatory protections in your jurisdiction. If a provision is held invalid or unenforceable, it is ineffective to that extent and the remaining provisions continue where legally permitted. Failure to enforce a provision on one occasion does not waive the right to enforce it later.
10. Changes to Terms
We may update these Terms as the Services or legal requirements change. Updates will show a revised Last Updated date. For material changes, we will give reasonable advance notice on the Services or by another appropriate means, unless an urgent legal or security reason requires an earlier change. Changes apply prospectively and do not remove accrued rights or retroactively change the rules for an existing dispute. We will obtain further agreement where required by law; continued use alone does not override such a requirement.
11. Google Maps Content
Google Maps content is owned by Google or third-party rights holders. We do not claim ownership of these photos. Your use of this content is subject to the Google Maps Platform Terms of Service.
